Terms and Conditions of Sale (TCS) – Le Mas du Camisard

1. Introduction
These Terms and Conditions of Sale govern the booking and rental of Le Mas du Camisard, located at 635 chemin Jean Cavalier, 30720 Ribaute-les-Tavernes (France), available via the website https://lemasducamisard.com.
By confirming a booking, the tenant acknowledges having read and accepted these Terms and Conditions without reservation.
2. Booking and Payment
2.1. Booking procedure
• Booking requests can be made through the contact form on the website, by email, or by phone.
• Availability confirmation will be sent within 3 days.
2.2. Payment
• A deposit of 30% is required to validate the booking.
• The balance must be paid no later than 30 days before arrival by bank transfer.
• If payment of the balance is not received within the deadline, the booking will be considered cancelled by the tenant, and the cancellation terms will apply.
3. Security Deposit
A refundable security deposit of €700 is required. It may be provided in one of the following ways:
In cash, directly to the concierge upon arrival. The amount will be returned at departure after inspection of the property.
Via the Swikly platform, which allows the amount to be pre-authorized (not charged) on a credit card. Once the stay is completed and the inspection validated, the owner will instruct Swikly to release the blocked amount.
The security deposit covers potential damages, losses, or breaches of the rental conditions. In case of damage, a deduction may be applied to cover the repair costs.
4. Insurance and Tenant’s Responsibility
The owner insures the property for seasonal rental use. However, the tenant is responsible for any damage caused intentionally or accidentally during the stay.
Most home insurance policies include a “holiday liability” clause (“Responsabilité Civile Villégiature”) covering accidental damage (fire, water damage, broken items, etc.) when renting a holiday property.
The tenant must provide a copy of their liability insurance certificate at least 30 days before arrival. If this document is not received, the owner reserves the right to cancel the booking without refund.

5. Cancellation and Refund Policy
5.1. Cancellation by the tenant
• More than 5 weeks before arrival: the 30% deposit is non-refundable.
• Less than 5 weeks before arrival: the full rental amount is due, unless the property is rebooked for the same period.
5.2. Cancellation by the owner
• In the event of cancellation by the owner, the full deposit will be refunded within 7 days.
6. Tenant Obligations
The tenant agrees to:
• Use the property exclusively for residential purposes and respect the neighborhood.
• Not exceed the maximum capacity (6 adults + 2 children or 4 adults + 4 children). A maximum of 6 adults is strictly enforced.
• Not sublet or transfer the booking without written consent from the owner.
• Keep the property clean and in good condition, respecting the inventory provided.
7. Automatic Termination Clause
In case of non-payment or non-compliance with the terms of this contract, and after a 10-day notice without resolution, the contract will be automatically terminated.
The owner may claim unpaid rent and charges, plus a 10% penalty.
8. Force Majeure
In case of force majeure (e.g. travel restrictions, natural disasters, government bans on rentals), the tenant may cancel their booking and receive a full refund.
Cancellations due to personal reasons or external circumstances not classified as force majeure will not entitle the tenant to a refund, unless otherwise agreed by the owner.
9. Jurisdiction
These Terms and Conditions are governed by Belgian law. In the event of a dispute, jurisdiction lies with the courts of the owner’s domicile (Belgium).
